Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Boomlink ("Boomlink," "we," "us," or "our"), concerning your access to and use of the Boomlink platform and services.
By accessing the Service, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
1. Intellectual Property Rights
Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.
Your Content: You retain all rights to the marketing content, landing pages, and campaigns you generate using the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display your content as necessary to provide the Service to you.
2. User Representations
By using the Service, you represent and warrant that:
- All registration information you submit will be true, accurate, current, and complete
- You will maintain the accuracy of such information and promptly update it as necessary
- You have the legal capacity and you agree to comply with these Terms of Service
- You are not a minor in the jurisdiction in which you reside
- You will not access the Service through automated or non-human means
- You will not use the Service for any illegal or unauthorized purpose
3. Fees and Payment
We offer various subscription plans. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
We bill you through an online billing account for use of the Service. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time but will notify you of any material changes before they take effect.
All payments shall be in U.S. dollars. You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.
4. Prohibited Activities
You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:
- Systematically retrieving data or other content from the Service
- Tricking, defrauding, or misleading us and other users
- Circumventing, disabling, or otherwise interfering with security-related features
- Engaging in unauthorized framing of or linking to the Service
- Using the Service as part of any effort to compete with us
- Selling or otherwise transferring your profile
- Using the Service for any form of spamming or unsolicited marketing
5. AI Content Generation
Boomlink uses artificial intelligence to generate marketing content. While we strive for high quality, you acknowledge that AI-generated content may contain inaccuracies or unintended biases.
Your Responsibility: You are solely responsible for reviewing and verifying the accuracy, legality, and appropriateness of all content generated and published through the Service. Boomlink is not liable for any damages resulting from AI-generated content.
6. Term and Termination
These Terms of Service shall remain in full force and effect while you use the Service. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF SERVICE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICE TO ANY PERSON FOR ANY REASON.
7. Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
